DECISION AND REASON:
--An information instigating a protest, lodged by Stipendiary Steward Mr J Muirhead, against CHINA CHINKO driven by Mr S Phelan, placed second by the judge, on the grounds of breaking from its gait free of interference with about 120 metres of the race finish and failing to promptly regain its gait. Mr Phelan represented the connections of the horse and endorsed the information, "I do not contest protest."
--Mr Muirhead demonstrated the incident by use of the video film. CHINA CHINKO broke from its gait, free of interference with about 120 metres of the race to run and continued galloping to the finish line.
--The Breaking Horse Regulation requires that such "breaking" results in either relegation or disqualification.
--In accordance with the usual practice, the committee disqualified CHINA CHINKO pursuant to Rule 1003.
--The amended placings being:-
