An Information was lodged by Stipendiary Steward Mr JM Muirhead against Junior Horseman Mr E Brosnan alleging that Mr Brosnan drove Crystal Desert carelessly causing interference to The Other Day (Driver J Lamb) when racing into the first bend.

Mr Brosnan admitted the breach and was present at the Hearing.   Mr Brosnan was supported by Senior Horseman Mr G Robb.

Rule 869(3)(b) states “No Horseman in any race shall drive carelessly”.

Mr Muirhead gave evidence by use of the video film and showed Mr Brosnan driving his horse forward from Number 6 at the gate and going into the first bend he was out four wide.   Mr Muirhead pointed out that Mr Brosnan was driving his horse on a loose rein and he slapped it up with the reins and he did not have any great measure of control over his horse.   Crystal Desert ran in on the point of the bend and interfered with The Other Day and caused that horse to break.   Mr Muirhead said that Mr Brosnan should have had a better hold over his horse and should have exercised more control and the driving was not to a standard that Mr Muirhead expected from Mr Brosnan.

Mr Robb on Mr Brosnan’s behalf said that Mr Brosnan was endeavoring to move around the horses inside him and to go to sit parked outside the leader because Mr Brosnan’s horse is one paced.   Mr Robb acknowledged the interference but put it down to being a misjudgment on Mr Brosnan’s part rather than a lack of control.

In respect to penalty Mr Muirhead recommended a suspension of Mr Brosnan’s Horseman’s License for a period of four weeks because he said the incident resulted from Mr Brosnan’s lack of control rather than being merely a misjudgment.   Mr Muirhead also stated that based on the number of drives that Mr Brosnan had, that a period of four weeks was warranted.

Mr Robb stated that in his opinion four weeks was excessive and that Mr Brosnan will have learnt from the incident and he submitted that a period of two weeks was sufficient.   Mr Robb said that Junior Horsemen needed driving experience and he believed that it was better for Mr Brosnan to be back driving after two weeks.   Mr Muirhead pointed out that Mr Brosnan could get driving experience from trials and workouts although Mr Robb counted this by suggesting that trials and workouts do not provide great experience because of the size of the fields.

In considering this matter I have looked at the film on a number of occasions.   The film clearly shows Mr Brosnan slapping up Crystal Desert with the reins and by the very nature of his actions he was driving on a loose rein.   It did appear that at the time of interference to The Other Day, Mr Brosnan did not have great control over his horse and reacted too late when it ran inwards.   Mr Muirhead was surprised at the standard of Mr Brosnan’s driving because he normally drove to a much better standard.

Taking all matters into account I ordered that Mr Brosnan’s Horseman’s License be suspended up to and including the 6th of June 2008.
