Following the running of race 6 the Stipendiary Stewards lodged an information instigating a charge against D Williamson the driver of Maybe Means No alleging that when shifting outwards on or about the home turn he checked Lady Fern (N Williamson).

DECISION & REASON

Following the running of race 6 the Stipendiary Stewards lodged an information instigating a charge against D Williamson the driver of Maybe Means No alleging that when shifting outwards on or about the home turn he checked Lady Fern (N Williamson).

At the outset of the hearing Mr D Williamson confirmed that the breach was not admitted and that he wished to be heard.

The relevant rule was read to the hearing by Mr McIntyre and said that in the Stipendiary Stewards' view Mr D. Williamson's actions had caused interference to Lady Fair, he then asked Mr N Ydyren to speak to the video evidence.

Mr N Ydyren asked the Committee to note that just prior to the incident complained of Maybe Means No (Mr D Williamson) was racing two out from the rail with Mr N Williamson's horse Lady Fern racing ahead of it and three out. Mr N Ydyren said that Lady Fern had paced roughly and shortly thereafter Maybe Means No moved outwards and checked Lady Fern who broke and lost all chance. He pointed out the releveant positions of the horses at the movement out of Mr D Williamson's horse and said that in his view the only reason for Lady Fern breaking was due to Mr D Williamson's outward movement causing his horse coming into contact with Mr N Williamson's horse.

Mr N Williamson said that just prior to the incident he had moved out three wide to follow a horse moving forward. Maybe Means No came out and checked his horse and he lost a number of lengths. Mr N Williamson also said that he did not move inwards at any time just prior or at the time of the incident. In response to a question from Mr D Williamson he acknowledged that Mr D Williamson had yelled at one stage and in response to a further question from Mr D Williamson also said that his horse was travelling well although not up on the horse in front.

Mr D Williamson then gave his opinion of the incident and that Mr N Williamson's horse galloped before his horse had moved. He emphasized that it was his view that Mr N Williamson's horse had broken of its own accord and that any movement outwards by his horse did not contribute to that.

The Committee after giving consideration to the matters referred to by the Stipendiary Stewards, the video evidence, the evidence of Mr N Williamson and the evidence of Mr D Williamson, finds as a matter of fact:

  • Lady Fern ? Mr N Williamson - prior to the alleged incident had paced roughly but had remained in its gait --

  • Maybe Means No ? Mr D Williamson ? moved from its two out to three wide position and in doing so interfered with Lady Fern causing that horse to break from its gait and losing its position in the race, and --

  • That no other horse or horseman contributed to the incident --

In arriving at its decision the Committee prefers the evidence of the Stipendiary Steward and Mr N Williamson which is in accordance with the video evidence of the race.

Mr D Williamson's reading of the incident is not supported by the video evidence. Accordingly the charge is found proven.

In respect of penalty the Stipendiary Stewards advised the Committee it did not appear that Mr D Williamson had appeared on such a charge during his 25 years of driving and accordingly had an excellent driving record. The Stipendiary Stewards recommended a fine of $200.00 or suspension for two days.

When asked to comment on the appropriate penalty Mr D Williamson declined to do so.

The Committee after giving consideration to the incident itself, the good driving record of Mr Williamson and the Stipendiary Stewards recommendation is of the view that a monetary penalty should only be imposed and, accordingly, Mr D Williamson is fined the sum of $200.00.
