Ms Carston you have admitted a breach of R 871(1)(d), careless riding, in that when racing midfield and 1 off the rail about 150 metres from the finish, you allowed your mount TALK ABOUT TOW to drift inwards to the running rail. The consequence of this was that Mr Robinson, who was racing on your inner, was forced to take hold of his mount and check out. You state that you were unaware that he was there until he called out and that you took hold immediately. However, as Mr Ching says, you continued to urge your horse and, in so doing, you continued to drift across.

Mr Ching has described the incident as low to mid range and has asked for a 4 to 5 day suspension. He stated your record was “reasonably good”. You have had only 2 previous breaches of the rule in your career which spans some 500 rides. These were in April and November last year.

We agree with Mr Ching’s description of the gravity of the breach. We take a starting point of 5 days and give credit to your good record and ready admission of the breach. You have riding engagements at Reefton and Kumara and ask for the suspension to be deferred until after this time. Mr Ching does not object to this. You are suspended from the end of riding on January 10 up to and including 22 January. This is 3 South Island racing days.
