----Mr Shutkowski the trainer/driver of the horse appeared for the connections of the said horse "RAESKI".
----Mr Shutkowski took the rule as read so Mr Taumanu went straight to the film. The film clearly showed "RAESKI" out of its gait for 50 metres or more, it also showed Mr Shutkowski was still slapping the horse up to when it first broke its gait.
----Mr Shutkowski had no questions of Mr Taumanu or his interpretations of the film.
----The Stipendary Stewards were of the view that the horse should be relegated to 5th rather than disqualified, which was an option.
----The Chairman after hearing all of the evidence and viewing of the films, was of the view that the horse had raced for more than 50 metres whilst out of it gait within the last 200 metres and therefore exercised his power and relegated "RAESK" to 5th.
