Following the running of Race 2 Mr. B Herd was charged with careless riding under Rule 871 (1) (d).
Following the running of Race 2 Mr. B Herd was charged with careless riding under Rule 871 (1) (d). The information alleged that Mr.Herd allowed his mount to shift out when not clear of "Touch Of Ebony" and kept "Dive Dive Dive" wide on the track shortly after the start.
--Mr. Herd admitted the breach.
--Mr. Bateup showed the head-on film of the start identifying Mr. Herd who was three stalls from the outside with Mr. K.Smith and Mr. A Calder outside of him.
--He pointed out that immediately after the horses jumped Mr. Herd's mount started shifting outwards dictating the line of Mr. Smith who had to check his mount off the heels of Mr. Herd's horse. Mr. Herd continued his outward movement shifting into the line of Mr. Calder.
--In relation to penalty Mr. Goodwin told the committee that Mr. Herd was last charged with careless riding on 28/12/04 for which he received a $1000 fine. He said that even with his good record it was his opinion that a suspension was justified.
--Mr. Herd, in commenting on penalty, asked that the committee take into account that Mr. Smiths horse was having its first start and that Mr.Calders horse had been slow away and that he was hunting it up when the interference occurred making the incident look worse than it was. He advised the committee of riding commitments through to Waimate on Sunday.
--Penalty
--In coming to a decision on penalty the committee took into account all of the submissions put before it including Mr. Herd's very good riding record, however two horses were affected by Mr. Herd's actions and we agree that a period of suspension is appropriate.
--Mr. Herd is suspended from racing from the close of racing today until the close of racing on Sunday July 16th.
