Following race 8 an information was filed pursuant to Rule 871(1)(d) by Stipendiary Steward Mr M Williamson, when it was alleged that Ms S Collett, rider of AUNTIE BRAM, permitted her mount to shift inwards near the 250 metres when not sufficiently clear of SPARKZRFLYING (B Yuill) who was checked.

Following race 8 an information was filed pursuant to Rule 871(1)(d) by Stipendiary Steward Mr M Williamson, when it was alleged that Ms S Collett, rider of AUNTIE BRAM, permitted her mount to shift inwards near the 250 metres when not sufficiently clear of SPARKZRFLYING (B Yuill) who was checked.

Ms Collett pleaded guilty to the charge.

Mr M Walker, Ms Collett's employer, was phoned and apprised of the charge, and gave his approval for the charge to go ahead. Ms Collett was also happy for the charge to proceed.

Mr Oatham demonstrated the video films which clearly showed AUNTIE BRAM rolling out in the home straight leaving a clear run on the inside for SPARKZRFLYING. Shortly after Ms Collett allowed her mount to roll back in approximately one horse width. This resulted in Mr B Yuill having to check.

Ms Collett explained to the committee that AUNTIE BRAM got tired and laid in as a result.

PENALTY SUBMISSIONS:

Mr Willliamson submitted that Ms Collett had an outstanding record with only one charge in her career. He said this breach was in the low to medium level of carelessness.

Ms Collett said she had commitments until after racing on 4th February 09.

The Committee considered all the evidence as presented and before imposing a fair penalty took into account the following:

  1. Ms Collett's outstanding record.
  2. --
  3. Level of interference to Mr Yuill which we believe to be at the lower end.
  4. --
  5. Ms Collett's guilty plea.

Accordingly we impose a suspension to start after racing on 4th February 09 and finish after racing on 8th February 09. (4 riding days)
