Decision:


Following Race 4 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Mr M Sweeney, rider of GALTIC STORM, permitted his mount to shift inwards near the 1800 metres when insufficiently clear of ROMAN GAL (D. Johnson).  This caused ROMAN GAL to be forced inwards causing severe crowding to KOUSSO (E Dalley), TOM KIAH (J Collett) and MEDIA GIRL (R Rattley)

Following Race 4 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Mr M Sweeney, rider of GALTIC STORM, permitted his mount to shift inwards near the 1800 metres when insufficiently clear of ROMAN GAL (D. Johnson).  This caused ROMAN GAL to be forced inwards causing severe crowding to KOUSSO (E Dalley), TOM KIAH (J Collett) and MEDIA GIRL (R Rattley)

Mr Sweeney pleaded guilty to the charge.

Mr Williamson demonstrated the video films which showed some initial tightening to inside runners from ROMAN GAL (D Johnson).  However shortly afterwards approaching the 1800 metre mark Mr Sweeney allowed his mount to move in and dictate the line of ROMAN GAL (D Johnson) when he was a bare length clear of that runner.  This resulted in crowding to 3 inside runners with MEDIA GIRL, who was on the rail, nearly falling.

Mr Sweeney said he believed he was used by Danielle Johnson as she was moving in before he did the same.  He was firmly of the opinion this contributed to the interference.  He said he was mindful of the horses on his inside and was not trying to dictate the line of ROMAN GAL.  He said as soon as Danielle called he pulled off.

PENALTY SUBMISSIONS

Mr Oatham said Mr Sweeney had 2 charges for careless riding in the last 12 months so his record was a good one.  He did concede that a mitigating factor in Mr Sweeney’s favour was that Danielle Johnson initiated the inward movement.  However he said that although the inward movement from Mr Sweeney was not great, he still moved in half a mowing strip when insufficiently clear, and there could have been dire consequences.  Mr Oatham submitted a 2 week suspension would be appropriate.

The Committee carefully considered all submissions and evidence.  Before imposing an appropriate penalty the committee gave due consideration to the following:

--

• Mr Sweeney’s guilty plea
• His good record
• His level of carelessness and the resultant check to 4 horses
• The mitigating factor that Miss Johnson did contribute to the tightening.

Accordingly we impose a suspension on Mr Sweeney from riding in races which is to start after racing on 22 August 2009 and conclude after racing on 4 September 09 (6 days)
