Following the running of Race 6, The Oaks Stud Manawatu Classic(Group 3) Mr B.Herd was charged with careless riding under rule 871 (1) (d). The information alleged Mr Herd permitted his mount Castlebar to shift in when not clear of Overkaast
Following the running of Race 6, The Oaks Stud Manawatu Classic(Group 3) Mr B.Herd was charged with careless riding under rule 871 (1) (d). The information alleged Mr Herd permitted his mount Castlebar to shift in when not clear of Overkaast which was taken in across the line of Nerredson which was checked near the 200m.
--Mr Herd admitted the breach.
--Mr. Goodwin demonstrated the incident by way of two video films. He identified Mr Herd riding Castlebar with Ms Satherley(Overkaast) on his inside and Mr Du Plessis inside of her. Castlebar moved in from wide on the track when ridden with vigour and crowded Overkaast into Nerredson which was severely checked losing considerable ground.

--Mr George submitted that more severe penalties are warranted in Group races and that Mr Herd continued to ride his mount Castlebar whilst moving inwards and causing interference. He told the committee that the check to Nerredeson was a severe one and he would recommend a suspension and a fine.
--The committee took into account all of the submissions and gave credit for the fact that Mr Herd admitted the breach. We also took into account Mr Herd's good riding record and would like it noted that we did not consider the latest suspension as it was under appeal.
--In coming to a decision on penalty we also had regard to the status of the race (Group 3), the stakes payable of the race and the nature of the interference. Nerredeson received a severe check losing ground at a vital stage of the race and Mr Herd did not stop riding and attempt to straighten his mount.

Mr Herd is suspended from riding from the close of racing on Wednesday April 4th until the close of racing on ThursdayApril 12th. In addition we impose a monetary penalty of $1000.00.
