Decision:
Rule 520(4)(c) : Every rider commits a breach of these Rules who:
Wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse.
Mr Davidson (Stipendiary Steward) alleged that Mr I Khairil had accepted two rides (DUNBLANE R7) and (DISCOVERY BAY R9)at 53 KG. Also that Mr Khairil weighed in 2kg heavy at 55 kg.

--Mr Khairil stated that he was just back from holiday, and that he believed that he could make the weight.
--Mr Davidson explained that Mr Khairil had previously been fined twice for the same offence over the past month. Specifically $150 on 13 April (Riverton) and $300 on 26 April at Blenheim. Mr Davidson suggested a range of penalty at a 3-4 day suspension. When asked to comment as to possible penalty, Mr Khairil stated that he would prefer a fine because "if I am not riding I will put on weight".
--The Committee adjourned to consider penalty.
--Decision/Penalty/Reasons
--The Committee decided to suspend Mr Khairil for three South Island riding days. Before setting those days, Mr Khairil was given the opportunity to invoke the seven day rule, if he had committments. Mr Khairil stated that he did not wish to do so. Consequently the Committee suspended Mr Khairil from riding up to and including racing on the 22 May 2009. effectively including racing at Oamaru (14 May), Gore (20 May) and Christchurch (22 May).
--In reaching this decision, the Committee took into consideration :
--(1) Early guilty plea.
(2) The fact that Mr Khairil had just returned from holiday.
The Committee felt that in this instance, a more serious penalty was required and reminded Mr Khairil of his responsibilities as a jockey to the owners, trainers, raceday officials and the racing public.
