DECISION AND REASONS:

Following the running of Race 11, harnessworld.com Online Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr P T Court, alleging a breach of the push-out Rule in that Mr Court, as the driver of BOLD N BEAUTIFUL in the race, forced SPIRIT OF ASHLEY (K M Barron) to race wider on the track with approximately 1600 metres to run.

Mr Court was present at the hearing and admitted the breach.

Mr B D Williams, Assistant Stipendiary Steward, showed video replays of the relevant part of the race. He pointed out BOLD N BEAUTIFUL racing 3-back on the outside, with approximately 1600 metres to run, being followed by SPIRIT OF ASHLEY. He then pointed out Mr Barron come out and get alongside Mr Court's sulky wheel just before Mr Court himself came out. As a result, Mr Barron was forced to race 4-wide.

Mr Court admitted that he had breached the Rule but submitted that both horses had been pulled out at the same time but, in Mr Barron's case, he had "gone at speed". Had he not done so, Mr Barron could have easily got onto Mr Court's back rather than being forced to race wider. It was "touch and go", Mr Court submitted. Mr Court also explained that his horse was wearing a pole on its near side which did not help. When the horse ran out a bit he had to "go".

Mr McIntyre informed the Committee that Mr Court had not committed any breach of the Rules in the past 12 months. Mr McIntyre recommended that a fine of $200.00 was usual for a breach of the push-out Rule in these circumstances.

The Committee adjourned to consider penalty. The Committee had regard to the submissions of the parties, Mr Court's previous good record and his admission of the breach. The Committee was satisfied that a fine of $200.00 was appropriate for the particular breach, in all of the circumstances, and Mr Court was fined the sum of $200.00 accordingly.
