The information alleges that PHANTOM PRINCE placed first by the Judge caused interference to HOT DEPUTY placed third by the Judge.          The interference occurred in the early part of the straight.

PHANTOM PRINCE was ridden by Mr D Walsh and HOT DEPUTY by Mr B Herd, the Informant.

The winner’s margin was 1 length with a nose back to third.

--

The rule was read and Mr Herd was then asked did he wish to call any witnesses, he did not, so went straight to the films.

Mr Herd demonstrated on the films how Mr Walsh had come out on his mount forcing him to check his horse.

--

Mr Walsh had no questions of Mr Herd.

Mr George asked Mr Herd how much ground did he think the alleged interference had cost his mount, Mr Herd said he felt his mount was held up for 8 to 10 strides.

Mr Walsh for his part felt he was always sufficiently clear and it was just unfortunate that Mr Herd’s mount was not going good enough to get to the outside fence before he did.

Mr George in his submissions said he felt it was questionable whether Mr Walsh’s mount was sufficiently clear when crossing Mr Herd’s mount but he also felt it inconclusive that HOT DEPUTY given a clear run would have beaten PHANTOM PRINCE home, however this he said was up to the JUDICIAL PANEL to decide.

Mr Herd in his final submission said Mr Walsh’s horse in his opinion was definitely not the required distance clear when taking his line, but he went on to say, I quote” I’m, not saying I would have beaten the winner” but felt he had not been given a clear run from the top of the straight.

Those present when asked were happy they had had a fair hearing and left the Committee to arrive at a decision.

Prior to arriving at a decision the Judicial Panel took into account all of the evidence both verbal and the films shown to them.  They were of the opinion it did not warrant a change of placings.

They therefore dismissed the protest.
