Following the running of Race 6 an information was filed by Stipendiary Steward Mr N Ydgren against licensed driver Mr G Payne alleging that Mr Payne drove in a manner which did and was likely to cause interference to another horse

DECISION & REASON
--Following the running of Race 6 an information was filed by Stipendiary Steward Mr N Ydgren against licensed driver Mr G Payne alleging that Mr Payne drove in a manner which did and was likely to cause interference to another horse namely Mitcheals Bay (Mr K Barron). Mr Payne was present at the Hearing of the information and confirmed that the breach was denied.
----Mr Ydgren said that after 150 metres from the start of the race, Mr Payne's horse had put pressure on Mr Barron's horse who had to restrain his horse to avoid contact.
----Mr Barron said that after approximately 150 metres from the start, there was tightening and contact by the horses on the inside and outside of him. He said that the pressure came from the outside horse who moved in and as a result he had to take hold of his horse and it lost its position. He said he was entitled to be in the position that he was in and was trailing the horse in front. He confirmed, in response to a question from the Stipendiary Stewards, that there was no room for Mr Payne to shift his horse in. Mr Ydgren then stated that under the Rules, Mr Barron was entitled to maintain his position and did not have to give way to the outside horse.
----Mr Payne said that he was trying to given his horse a good run and suggested to Mr Barron that the tightening was due to movement from the intside. Mr Payne further said that he thought he was entitled to take the action that he did.
----The Committee after giving consideration to the video evidence which supported the contentions of the Stipendiary Stewards and Mr Barron, finds that Mr Payne did drive in a manner which did or was likely to cause interference to another horse, namely Mitcheals Bay. In that regard, the evidence of the Stipendiary Stewards and Mr Barrron is preferred to that of Mr Payne.
----In respect of penalty, Mr Ydgren said that Mr Payne had a good record and had not appeared on such a charge over the last 12 months. The Stipendiary Stewards recommended a fine of $200 or a suspension. Mr Payne indicated that he preferred a suspension.
----Having given consideration to the submissions of both parties as to penalty, the Committee is of the view that a suspension is in order on this occasion and accordingly Mr Payne's licence to drive is suspended from completion of racing today, 4 June 2007 until completion of racing on 14 June 2007 (an effective 3 days).
