An information (7490) was laid by Stipendiary Steward Mr S Ching under Rule 508(2) (5) alleging that trainer Mr S Marsh failed to declare riders for MONET SPINNA (Race 3) and VALDORADO (Race 7) by the required time.

An information (7490) was laid by Stipendiary Steward Mr S Ching under Rule 508(2) (5) alleging that trainer Mr S Marsh failed to declare riders for MONET SPINNA (Race 3) and VALDORADO (Race 7) by the required time.

Rule 508 (2) (5) reads

--

It shall be the duty of the trainer of any horse which he has or is deemed to have been accepted for a race, for which the Club has required the declaration of names of riders, to declare to the Club, at the place and not later that the time specified by the Club, the name of the rider of the horse trained by him which has or is deemed to have been so accepted.

(5) Every trainer, who fails to discharge a duty imposed upon by this rule commits a breach of these Rules.

Mr Marsh admitted the breach and was represented by Mr Marr at the meeting. Mr Marsh did not wish to be present at the hearing.

--

Mr Ching stated that rider declarations were due at 4pm on Wednesday 15 July, and Mr Marsh declared riders for his two horses MONET SPINNA (Race 3) and VALDORADO (Race 7) at 7.15am on Thursday 16th July.

Mr Ching stated that there appeared to be no mitigating circumstances as to the late declaration.

DECISION

--

The Information was upheld as the Committee was clearly satisfied a breach of the Rule had occurred.

--

In fixing penalty Mr Ching stated that Mr Marsh had two breaches under this Rule in the past twelve months, namely at the Wanganui meeting on 7th May 2009 (Fined $50) and on the 21st March 209 at the Tauranga meeting (fined $100).

--

The Committee, in fixing penalty took into account that this was now Mr Marsh’s third offence in the past twelve months and as a consequence, Mr Marsh was fined the sum of $150.
