Following the running of Race 1, the Radio Sport 1400, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 868(5) alleging that Licensed Trainer Mr S. B. Marsh, the trainer of “Monte Cervino” (2), failed to race that horse in declared gear.

--Mr Marsh had indicated on the Information that he admitted this breach, and that he did not wish to be present at the hearing. Mr Sanders recommended a fine of $100-00 for this breach. We were satisfied that this was an appropriate amount and accordingly Mr Marsh was fined the sum of $100-00.
