RACEDAY JUDICIAL COMMITTEE DECISION
--Informant: J. Oatham
--Defendant: M. Cameron
--Information No: 365
--Meeting: Auckland Racing Club
--Date: 5 June 2010
--Venue: Ellerslie
--Race: 10
--Rule No: 638(1) (d)
--Judicial Committee: N. Moffatt, Chairman – A. Dooley, Committee Member
--Plea: Admitted
----
CHARGES:
--Following the running of Race 10 an information was lodged alleging a breach of rule 638(1) (d) in that M. Cameron permitted your mount CHICKILICIOUS outwards resulting in LA BELLA EPOQUE being badly hampered near the 400m.
----
FACTS:
--Mr Oatham asked Mr George to outline the incident on the available films. He showed Mr Cameron, riding the eventual winner of the race, shift outwards when looking to improve into a gap where there was insufficient room for him to do so. As he angled outwards he badly hampered Ms N. Collett who in turn interfered with the mount of Mr Innes.
----
Mr Cameron had nothing to add in relation to the interpretation of the films by Mr George.
----
SUBMISSIONS ON PENALTY:
--Mr Oatham said that Mr Cameron had previous charges of careless riding on 23/10/09 and 31/1/10 for which he received 5 day suspensions for each. He said that Mr Cameron was a North Island rider with a good record and this incident was regarded as being in the lower to mid range of careless riding.
----
Mr Cameron had nothing to say in relation to submissions on penalty but did inform the committee that he had riding engagements up to and including Matamata on Wednesday June 9th.
----
REASONS:
--In coming to a decision on penalty the committee took into account Mr Cameron’s admission of the breach, his good riding record and the degree of carelessness.
----
It was our opinion that a four day suspension was the appropriate penalty and in determining the days of the suspension we had careful regard to Mr Cameron’s riding commitments and the fact that he rides in the North Island.
----
PENALTY:
--Mr Cameron is suspended from riding from the conclusion of racing on Wednesday June 9th until the conclusion of racing on Thursday June 17th.
