--Mr Harris admitted the breach.
--Mr Sanders alleged that Mr Harris (HIGH POWERED) allowed his mount to shift out when not clear near the 350 metres causing a check to LUNUS (J Todd).
--Mr Oatham demonstrated the video films which showed Mr Harris moving out near the 350 metre mark and taking the line of LUNUS when not sufficiently clear. Mr Oatham conceded there was slight inward movement from EL BEE DEE which did contribute to the interference.
--Mr Harris, while admitting the breach, said he thought he was clear and said EL BEE DEE who was on the outside of LUNUS rolled in contributing to the interference.
--PENALTY SUBMISSIONS:
Mr Oatham produced Mr Harris’ record which showed only two charges in the last 12 months. He reminded the Committee it was a group III race, but there were mitigating factors in Mr Harris’ favour. He said it was at the lower end of carelessness and submitted a suspension of 5 – 7 days, and a fine would be appropriate. He said that due to the unusual circumstances of the inquiry having to be adjourned, the Stewards agreed that Mr Harris’ decision to stand down today, be taken into account.
Mr Harris had nothing further to add.
--PENALTY:
The Committee took into account all evidence and submissions, particularly the following:
1. Mr Harris’ guilty plea.
2. His good record.
3. Level of carelessness which we consider low.
4. Status of race.
Accordingly we impose a suspension on Mr Harris from riding in races from the beginning of today’s racing, 6.8.09, and conclude after racing on 13.08.09 (5 days). In addition we impose a fine of $500.
