DECISION AND REASONS:
--Following the running of Race 4, Aotea Electric Canterbury Limited Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr G D Smith, alleging a breach of Rule 507A in that Mr Smith, as the driver of BLACK HEART in that Race, failed to take his drive on that horse until 5 minutes prior to the start of the Race.
----Mr Smith had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information.
----The Committee found the charge against Mr Smith to be proved.
----Rule 507A provides as follows:
--Every horseman shall be available to take their engagement to drive a horse at least fifteen minutes prior to the race start time, except when otherwise directed by a Stipendiary Steward.
----Mr McIntyre informed the Committee that Mr Smith had offered no explanation for the breach. Mr McIntyre recommended a fine of $100.00 and referred to a recent fine of that amount imposed on horseman, T W Mitchell, for a breach of the same Rule at a recent North Island meeting.
----Mr Smith was fined the sum of $100.00.
