Following race 7 an information was filed pursuant to Rule 912(1) requesting a ruling as to whether MELANION (L Callaway) or NORVILLE PRINCE (C Anderson) were denied a fair start due to a mechanical failure of the starting gates.

DECISION & REASON:

Following race 7 an information was filed pursuant to Rule 912(1) requesting a ruling as to whether MELANION (L Callaway) or NORVILLE PRINCE (C Anderson) were denied a fair start due to a mechanical failure of the starting gates.

Mr Robinson, Assistant Stipendiary Steward, demonstrated the video films and showed both horses which were starting from gates 3 and 4 very slow to begin. He pointed out how NORVILLE PRINCE had moved forward prior to the start of the race, and in doing so hitting the front of the gates. NORVILLE PRINCE then moved backwards at which time the starter released the gates. It could be clearly seen that gates 3 and 4 were slow in opening.

Mr J Humphries, starter, said he heard a bang which was different from normal, and one of his assistants said it was caused by NORVILLE PRINCE trying to anticipate the start. He confirmed that the bang to the gates caused by NORVILLE PRINCE would have made gates 3 and 4 be slow in their opening. He was adamant there was no mechanical failure of the gates.

Ms C Anderson, rider of NORVILLE PRINCE, said she didn?t think she hit the gates very hard.

Mr L Callaway, rider of MELANION, said he went to go but the gate didn?t open and he had to push his way out.

Mr Oatham in summing up said the 2 gates were both slow to open. He felt this was no fault of MELANION?S, but the question that had to be answered was what part did NORVILLE PRINCE play in the gate delay.

The Committee considered all the evidence and repeated viewing the video films. We are satisfied that NORVILLE PRINCE by applying early pressure on his gate contributed to the slow opening of both gates. We therefore rule that NORVILLE PRINCE is declared a runner because there were no extraneous reasons other than those caused by itself.

Accordingly in the case of MELANION, because he was not at fault in his gate delay we order a refund of all bets.
