Decision:
At the conclusion of Race 5, The Thermakraft Industries Ltd Mobile Pace, a protest was lodged (Information 13345) by Stipendiary Steward Mr PT Knowles, under Rule 869(8)(b), alleging with approximately 250 metres to run SAKWI, driven by Mr AL Stratford, shifted ground inwards checking TRENDY’S ROCKET, driven by Mr BD McLellan.
DECISION AND REASON:
--At the conclusion of Race 5, The Thermakraft Industries Ltd Mobile Pace, a protest was lodged (Information 13345) by Stipendiary Steward Mr PT Knowles, under Rule 869(8)(b), alleging with approximately 250 metres to run SAKWI, driven by Mr AL Stratford, shifted ground inwards checking TRENDY’S ROCKET, driven by Mr BD McLellan.
--Mr Stratford confirmed he represented the owners of SAKWI at the protest hearing.
--Stipendiary Steward Mr CJ Allison used several Trackside video clips (side-on and head-on) to demonstrate where, in his opinion, the alleged interference took place.
--Mr Allison stated that SAKWI was travelling in the four wide position entering the straight, and then moved inwards approximately half a cart width, brushing with TRENDY’S ROCKET. At that point TRENDY’S ROCKET losing its forward momentum, with TRENDY’S ROCKET losing up to two lengths.
--The driver of TRENDY’S ROCKET, Mr B McLellan, stated that he was travelling on the inside of SAKWI, when it moved inwards taking his line, and as a result the horse’s momentum was lost.
--Mr McLellan stated TRENDY’S ROCKET finished the race off strongly once balanced, and that his horse finished on the outside of SAKWI at the finishing post. Mr McLellan believed his horse hade lost up to two lengths because of the alleged interference.
--Mr Knowles stated that the margins between first and second were half a length, and the margins between second and third were half a length.
--Mr Stratford did not dispute the allegation his horse had moved inwards and had brushed with TRENDY’S ROCKET.
--Mr Stratford stated that he believed there had been some outwards movement from the inside horses that had contributed to the incident. He also stated that he believed TRENDY’S ROCKET only lost half a length as a result of the interference, not up to two lengths as stated by Mr McLellan and Mr Knowles.
--Decision:
--After having heard all of the evidence, and viewed the Trackside head-on and side-on video clips, the protest is upheld with the first horse placed by the judge, SAKWI, being relegated to third placing.
--In my opinion the verbal evidence of Mr McLellan was compelling, and was supported by the video clips of the incident.
--SAKWI has been travelling in the four wide position, and by Mr Stratford’s self admission moved inwards and taken TRENDY’S Rocket’s racing line. The loss of TRENDY’S ROCKET momentum, and the fact the horse once balanced finished the race off strongly, coupled with the finishing margins at the conclusion of the race, half a length between first and second and third respectively, were all very significant factors in the decision. I do not accept Mr Stratford’s opinion that the inside horses played a significant role in the incident.
