Following the running of race 6 the Stipendiary Stewards lodged an information against Mr C J De Filippi under rule 857 (7) (g) alleging that Mr De Filippi failed to take up the correct position behind the mobile gate until late, therefore, not allowing room for MAHALA TAJ  (R T May) to take up its rightful position at the start.



Following the running of race 6 the Stipendiary Stewards lodged an information against Mr C J De Filippi under rule 857 (7) (g) alleging that Mr De Filippi failed to take up the correct position behind the mobile gate until late, therefore, not allowing room for MAHALA TAJ  (R T May) to take up its rightful position at the start.

At the outset of the hearing the Committee noted that Mr De Filippi admitted the breach in writing and did not wish to be heard. The charge is found proven.

The Stipendiary Stewards demonstrated the incident with the assistance of the video evidence which clearly showed Mr De Filippi making a late move to his starting position and therefore denying MAHALA TAJ from taking up its rightful position.

In respect of penalty the Stipendiary Stewards advised that after discussion of the incident Mr De Filippi accepted his culpability and hence his guilty plea. It was also advised to the Committee by the Stipendiary Stewards that this was the first offence under this rule by Mr De Filippi in the last preceding year.

--

In respect of penalty after giving consideration to the effect on the innocent horse,  the early guilty plea and Mr De Filippi’s clear record under this rule the Committee agrees that a fine only is appropriate. Accordingly, a fine of $200.00 is imposed.
