Jockey H Tinsley admitted a breach of rule 871 (1) (d) in that near the home turn, H Tinsley permitted MR PINKLES to shift out when not clear



Jockey H Tinsley admitted a breach of rule 871 (1) (d) in that near the home turn, Mr Tinsley permitted MR PINKLES to shift out when not clear, severely hampering MOLLY O'REILLY (C. Lammas), HAVANA JACK (K. Collins), SHY (M. Cameron) and SOUTHERN CRY (M. Du Plessis).

 Stipendiary Steward Mr. Davidson showed the available films and informed the committee of the outward movement of Mr Tinsleys mount when not sufficiently clear causing interference to the horses on his outside.

 Jockey H Tinsley while admitting the breach, informed the committee his actions were dictated by his belief that the horses racing in front of him were in very tight quarters.  As a senior jockey riding for 17 years, he could read a race, and felt that if he continued where he was on the fence, a serious incident could have happened.  Stipendiary Steward George concurred with jockey Tinsley's comments about the horses ahead of him but also pointed out the sharp outward movement of Mr Tinsleys mount caused interference to the four horses on his outside.

 Submissions of Penalty:

 Mr. C. George told the committee that jockey H. Tinsley had last been charged under this rule in the 2003/2004 season.  His riding is of a very high standard.  However, because four horses were seriously inconvenienced in the incident he asked for a period of suspension.

 Jockey Tinsley informed the committee that he does ride in both the north and south islands and as an experienced senior jockey it is his intention to ride as regularly as possible.

 Decision and Reason:

--

 Mr. Tinsley, in deciding to impose a period of suspension for your breach of rule 871 (1) (d) this committee has taken into account your admittance of the breach, and your record under this rule, which is an exemplary one, considering the amount of race riding you undertake.  These considerations have been tempered by the fact four horses were affected by your actions in this incident.  This committee has decided to suspend you from race riding from after the completion of  racing on Sunday the 25th of February until the completion of racing of Saturday the 3rd of March.
