Decision:
Following the running of Race 1, The Outdoor Power & Hire Handicap Trot , an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr B Holmes, the driver of “Imatrotnovsky” (2), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively over the concluding stages of the race.
DECISION AND REASONS:

Following the running of Race 1, The Outdoor Power & Hire Handicap Trot , an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr B Holmes, the driver of “Imatrotnovsky” (2), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively over the concluding stages of the race.

Mr Holmes indicated on the information he admitted this breach of the Rules and he confirmed this at the hearing. He also agreed he understood the charge and the Rule it was laid under.
----
Stipendiary Steward Mr McIntyre used video coverage to show this incident, which related to Mr Holmes using his whip on over 30 occasions in the final 200 metres of the race. Mr Holmes conceded that what he had done was wrong. He said that members of the public would see that his use of the whip was excessive even though he didn’t feel he was punishing the horse as he was hitting the sulky shaft.

Mr Taumanu advised that Mr Holmes had no previous breaches of this rule. He stated that he thought the offending was as the lower end of the scale and that a fine of $250-00 or a one week suspension was appropriate. The choice of a fine or a suspension was raised with Mr Holmes, and he said that he preferred a suspension.

After considering the film of the incident and the submissions of the Stipendiary Stewards and Mr Holmes we believe a period of suspension is appropriate. Mr Holmes is suspended from close of racing today 15 February 2009 to the close of racing on Sunday 22 February 2009 which is effectively 2 days.
