Following the running of Race 6, Swannanoa Station Mobile (PBD) Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Graduation Horseman, Mr J D Burgess, alleging a breach of Rule 864 (2) (e) in that Mr Burgess failed to activate the earplugs on SILVERDALE PRIDE.



Following the running of Race 6, Swannanoa Station Mobile (PBD) Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Graduation Horseman, Mr J D Burgess, alleging a breach of Rule 864 (2) (e) in that Mr Burgess failed to activate the earplugs on SILVERDALE PRIDE.

Mr Burgess had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 864 (2) (e) provides as follows:

--

(2)     Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-

--

(e)     that all steps are taken to activate gear, appliances or devices which requires activation.

--

Mr McIntyre informed the Committee that Mr Burgess had told the Stewards that SILVERDALE PRIDE had been travelling well turning for home and believed the mare was going to be in the finish. He elected not to pull the ear plugs at that time. In the run home, Mr Burgess had explained, he simply forgot.

Mr McIntyre recommended a fine of $100.

Mr Burgess was fined the sum of $100.
