Following the running of Race 10, the Dennison's Joinery Mile, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging careless riding by Jockey Mr C. W. Johnson.

DECISION AND REASONS:
--Following the running of Race 10, the Dennison's Joinery Mile, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging careless riding by Jockey Mr C. W. Johnson.
--The information reads as follows.
--"I the abovenamed informant allege that the abovenamed Defendant
------committed a breach of Rule 871(1)(d) in that C. Johnson (Show Cat) allowed his mount to shift ground outwards when not clear causing buffeting to Te Mata Prince (T. Moseley) and Rokeur (J. Cameron) near the 200m."
--Rule 871(1)(d) reads as follows.
--"(1) Every rider commits a breach of these Rules who in the opinion of the
--Judicial Committee is guilty of riding which was:
--(d) Careless'."
--Mr Johnson had indicated on the information that he did not admit this breach and he confirmed this at the hearing. Mr Johnson agreed that he understood the Rule and the nature of the charge.
--Jockey T. Moseley gave evidence that he received interference at about the 200 metre mark and at that stage there was contact between Mr Johnson's horse and his horse. Mr Moseley agreed that the contact was "firm".
--Jockey J. Cameron gave evidence that at about the 200 metre mark she received pressure and slight contact from Mr Moseley's mount which was racing on her inside, and believed that the pressure came from Mr Johnson's horse.
--Stipendiary Steward Mr McLaughlin showed video coverage of the incident, which showed that Mr Johnson moved outwards looking for room to improve. At about the 200 metre mark Mr Johnson made contact with Te Mata Prince, pushing it off it's line. This also resulted in Rokeur being pushed outwards.
--Mr Ching submitted that there was never sufficient room for Mr Johnson to find the racing room he needed. Mr Ching also said that there was never a gap there for Mr Johnson to take.
--Mr Johnson was given the opportunity to ask questions of the witnesses and the Stipendiary Stewards, but chose not to do so.
--Mr Johnson gave evidence that at about the 200 metres he was endeavouring to angle out from behind Mr Bullard's mount and that when he got up by that horse's hind quarters Mr Bullard's horse moved causing him to move wider than he wanted to. Mr Johnson agreed that there had been contact between his horse and Mr Moseley's horse.
--Mr Ching agreed that there had been some movement from Mr Bullard's horse, this movement had made Mr Johnson's situation worse, but had not been the main cause of the problem. Mr Ching also agreed that the carelessness was in the middle range.
--After hearing the evidence we adjourned to consider our decision. We were satisfied that Mr Johnson had moved outwards making contact with Te Mata Prince, and this caused Rokeur to be pushed wider on the track. We were satisfied that the actions of Mr Johnson constituted careless riding.
--On returning to the enquiry room we advised that a full written decision would be given later, and we gave the following oral decision.
--"Having heard the evidence and having seen the video coverage we are satisfied that you did move outwards and make contact with Te Mata Prince. This incident took place when you were trying to find racing room. We find that the charge has been proved."
--Penalty: In relation to penalty Mr Ching advised that Mr Johnson has had three careless riding convictions in the last 12 months, these being in August, September and October 2006. Mr Ching said that Mr Johnson is a very busy rider and that it should be taken into account, to his credit, that he has not breached this Rule for the last 4 months. Mr Ching also assessed the seriousness of the breach as being in the middle range, and conceded that the movement of Mr Bullard's horse was a contributing factor.
------Mr Johnson made submissions and emphasised that it was 4 months since his
--last careless riding charge, and that he has had a lot of rides in that time.
--We adjourned to consider the matter of penalty. We took into account the following matters ?

- Mr Johnson's good riding record over the last 4 months. --
- That the breach was in the middle range of seriousness. --
- That there was some contribution to the incident from Mr Bullard's horse.

On returning to the enquiry room we advised that a full written decision on penalty would be given later and we gave the following oral decision.
------"In coming to our decision we have taken into account that this was, as
--described by Mr Ching, mid range, and also the mitigating matter referred to by Mr Ching, and finally that you haven?t had any breaches of this Rule since October and you are a very busy rider. You will be suspended for three days which is from after the completion of racing on 28 February 2007 until after the completion of racing on 4 March 2007."
