Following the running of Race 7 an Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU on behalf of Horse 7 CAUSEWAY BAY STAR ( Driver G Robb) placed 8th by the Judge against Horse 2 MATTIE GLEN (Driver N Chilcott), placed 3rd

Following the running of Race 7 an Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU on behalf of Horse 7 CAUSEWAY BAY STAR ( Driver G Robb) placed 8th by the Judge against Horse 2 MATTIE GLEN (Driver N Chilcott), placed 3rd , alleging a breach of the Push Out Rule and subsequent Interference

The respective drivers appeared and represented the connections.

Evidence was given by Stipendiary Steward Mr J Muirhead with reference to Video tapes of the race. The evidence clearly showed Miss Chilcott to move from the rail approximately 25 to 30 metres before the final 1000 metres of the race. In doing so she forced Causeway Bay Star three wide as he was improving and prevented him from moving into the one one position and severely affecting his chances.

Miss Chilcott openly admitted she had breached the push out rule in coming out too early and did not contest the evidence provided. No evidence was required from Driver G Robb.

Mr Taumanu recommended that MATTIE GLEN be disqualified and the Judges placings be amended accordingly. He also submitted that Driver Miss Chilcott through her actions had clearly restricted the chances of Causeway Bay Star and was guilty of Interference.

Miss Chilcott agreed that her driving had interfered with another runner and agreed with the recommended penalty of a $200 fine.

Mr Taumanu further submitted that this penalty be applied within the framework of Rules 869(8) and 1003 without any requirement for a further information. This matter was discussed at length as this course of action had been recommended following legal advice from HRNZ.

Accordingly these submissions were accepted.

Decision and Penalty

--

The actions of MATTIE GLEN and her driver Miss N CHILCOTT clearly breached the PUSH OUT RULE pursuant to Rule 869 (6)(b +c) in that the outwards movement was commenced prior to the final 1000 metres of the race. In doing so Rule 869(4) was breached in that interference was caused to CAUSEWAY BAY STAR in that he was forced wider on the track and prevented from moving into the one one severely affecting his chances

I therefore disqualify MATTIE GLEN and the amended placings are as follows

1st 9 SEMAJ

2nd 4 POCKET MAESTRO

3rd 5 ENUNCIATOR

5th 1 EYES FLYING

6th 6 ROYAL SEAL

Pursuant to Rules 869(8) and 1003 and in line with accepted submissions from the Stipendiary Stewards Miss Chilcott is fined $200 for Interference . This penalty is as recommended by both parties and takes into account the frankness honesty and courtesy displayed by Miss Chilcott during the course of the Hearing
