FACTS:
--An Information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu after the conclusion of Race 1. The protest was against horse 6 FOREVER FAITHFUL placed 1st on behalf of horse 10 CAPTAIN GIBBS placed 6th by the judge.

Present for the hearing were Mr A Pyers (owner/trainer/driver) of Forever Faithful, Miss N Chilcott (part owner/trainer/driver) of Captain Gibbs and Mr I Brownlee (trainer/driver) of Horse 7 Anvil Justice placed 2nd by the Judge.
----
The Information alleged that Forever Faithful had caused interference to Captain Gibbs racing into the first bend.

Mr Pyers confirmed he wished to contest the protest.

Mr Muirhead referred the hearing to camera footage of the relevant stage of the race and identified the horses concerned.

Mr Brownlee missed the start by about a length and half moved down onto Captain Gibbs forcing it onto the running line. At the same time Mr Pyers was three wide and easing back into the same position attempting to get onto the back of Mr Butcher on Lakadema. Mr Pyers in doing so ran Miss Chilcott out of room and broke.

Miss Chilcott said Mr Brownlee had come down and got her to the rail. She was pushed further and further down and then Mr Brownlee’s sulky wheel contacted the front leg of her horse and it broke. She couldn’t say whether the pressure had come from Mr Brownlee or a horse outside him.

Mr Brownlee said there was tightening going into the first bend. He got Miss Chilcott down onto the rail but he didn’t think Mr Pyers had realised that. Anvil Justice was lugging going into the bend and everyone was contesting for position. He said there was pressure from his outside but no contact with Mr Pyers.

Mr Pyers referred to Camera footage and explained his interpretation of the events. Mr Brownlee had missed the start by several lengths with his horse hanging quite badly. After the start
--he had come from behind and moved inside Mr Pyers still hanging and in doing so had cut Miss Chilcott off. Mr Brownlee had attempted to force his way into a position that he had already filled and that caused Miss Chilcott to run out of room and break. He blamed Mr Brownlee who he said should have taken hold. At the time Mr Brownlee was forcing up between him and Miss Chilcott he was already on the back of Mr Butcher who was two wide.

Mr Taumanu contended that Mr Pyers should have continued in the three wide position and if he had done so the interference would not have occurred.

DECISION AND REASONS:
--The Committee in arriving at this decision took particular note of the camera footage and the evidence of Mr Pyers.

It was clear that Mr Brownlee having missed the start had moved Miss Chilcott down to the running line going into the first turn.
----
Mr Pyers had moved down clear of Miss Chilcott and appeared to be almost on the back of Mr D Butcher two wide when Mr Brownlee attempted to improve and force into a position between the two that no longer existed and caused Miss Chilcott to break.
----
Little if any blame could be attributed to Mr Pyers

The Protest was dismissed and the original judge’s placings stood.

Payment of dividends was authorised.
