Following the running of Race 7 the Stipendiary Stewards lodged an information alleging a breach by A M Butt [Rose Show] under Rule 869 [3] [b].

Following the running of Race 7 the Stipendiary Stewards lodged an information alleging a breach by A M Butt [Rose Show] under Rule 869 [3] [b]. The Stipendiary Stewards alleged hat Mr Butt drove carelessly when moving Rose Show out when not clear of Rycol Falcon [JW Smolenski] causing that horse to break and lose all chance in the Race.

At the outset of the hearing Mr Butt confirmed his written admittance of the breach and acknowledged that the evidence from the enquiry was incorporated into this hearing. The charge is accordingly found proven.

In respect of penalty Mr Escott said Mr Butt had a previous breach of the Rule on the 21st July 2005 at which time he was fined $200.00. Mr Escott submitted that although this interference was at the lower end of the scale and that credit should be given to Mr Butt for his early guilty plea that it was his submission that a significant monitory penalty should be imposed this being the second similar offending by Mr Butt within a reasonably short period of time.

Mr Butt agreed that a monitory penalty was appropriate and left it to the Committee to impose the appropriate of that penalty.

The Committee after taking into account the aggravating features and some giving credit for the mitigating imposes a fine of $400.00
