| -- DECISION AND REASONS: --Following the running of Race 7, Copthorne Hotel Commodore Mobile Pace, an information was filed by Stipendiary Steward, Mr S T Larkins against Licensed Trainer, Mr M G Larter, alleging that the gear of BESSE?S BOY (trained by Mr Larter) in the race, "was of unfit state so as not to malfunction (breaking during run)" ----Mr Larter indicated on the information form that he admitted the breach. However, following the reading of Rule 864 (2) (d), he indicated that he wished to change his plea. Mr Larkins then sought leave to amend the information to allege a breach of Rule 864 (2) (b). Leave was granted. The amended charge was put to Mr Larter and the Rule read to him following which he indicated that he admitted the amended charge. ----Mr Larter was fined the sum of $100.00. |
