An information was filed by Chief Stipendiary Steward Mr N Escott, instigating a protest on behalf of KASYANOV driven by Mr L Chin, placed 9th against SOVEREIGNTY driven by Mr M McKendry placed 1st, on the grounds of interference when racing around the first bend.  Mr Chin represented the connections of KASYANOV and Mr C Hunter, Mr McKendry and Mr S McCaffrey the connections of SOVEREIGNTY.

Mr Chin said Mr McKendry’s horse came out under KASYANOV and caused it to break.   He was not sure if there was contact, there was so much noise.   KASYANOV stumbled and broke and nearly came down.  He had yelled out to Mr McKendry.   There was no contact from the horse on the outside of KASYANOV (that horse was in a break).    He told Mr McKendry there was no pressure from the outside horse.

Stipendiary Steward Mr J Muirhead showed the video film of the incident.   He said Mr McKendry had moved outwards to avoid the breaking of GLADYS EMANUEL...

Mr McKendry said he believed it was a combination of things – KASYANOV being squeezed from the outside, KASYANOV hanging in.  He confirmed there was no contact.   He said, “ I don’t know why I’m here.”

Mr Hunter said there was no evidence SOVEREIGNTY hit KASYANTOV.  There was movement on both sides, horses can panic, there was no interference, and he referred to movement by the horse outside KASYANOV.   Mr Chin said KASYANOV did not panic and was squeezed by the horse inside coming out.

Stipendiary Steward Mr T Taumanu suggested to Mr Chin there were mitigating circumstances, breaking horses etc.   He asked Mr Chin if he was clear about what had happened.    Mr Chin said he was.    Mr Taumanu told Mr Chin his evidence was wishy washy.     Mr Chin agreed and said, “It might just have been the circumstances.”

The video films did not show with precision what occurred.   Mr McKendry put the incident down to a combination of things as did Mr Hunter.    Mr Chin was initially clear that the outward movement of SOVEREIGNTY caused interference to KASYANOV even though there was no contact.   However, Mr Chin then acknowledged that his evidence was wishy washy and that it could have just been the circumstances.  The very uncertain evidence of Mr Chin left the committee in a state of doubt.    The protest is dismissed.
