This is an information instigating a protest filed by Stipendiary Steward Mr T TAUMANU on behalf of TURISMO driven by Miss A STORMONT placed 8th by the judge, ROYAL TIGER driven by Mr C BUTT placed 13th and DAKOTA KID driven by Mr T HALL placed 4th against BET YOUR LIFE driven by Mr D BRANCH placed 2nd on the grounds of interference racing into the first bend.

This is an information instigating a protest filed by Stipendiary Steward Mr T TAUMANU on behalf of TURISMO driven by Miss A STORMONT placed 8th by the judge, ROYAL TIGER driven by Mr C BUTT placed 13th and DAKOTA KID driven by Mr T HALL placed 4th against BET YOUR LIFE driven by Mr D BRANCH placed 2nd on the grounds of interference racing into the first bend.  Mr B HACKETT represented the connections of BET YOUR LIFE.

Stipendiary Steward Mr J MUIRHEAD gave evidence of his observations of the incident in question and his interpretation of the video films.  He said POWERTOFLY driven by Mr Z BUTCHER was leading into the first bend; TURISMO was outside it and BET YOUR LIFE outside TURISMO.  TURISMO was eased into the trail and then Mr BRANCH tried to move BET YOUR LIFE into the trail when there was insufficient room to do so.  This caused TURISMO to pace roughly and be restrained.  This caused interference to ROYAL TIGER which was behind TURISMO.  ROYAL TIGER broke and this caused interference to DAKOTA KID which was racing behind it.  All three horses lost ground and their chances were affected. 

Miss STORMONT said BET YOUR LIFE moved inwards quickly and its sulky wheel touched the front leg of TURISMO which then went rough and nearly galloped.  She restrained TURISMO and lost the trailing position which affected her chances. 

Mr BUTT said ROYAL TIGER was squeezed up a bit by the horse on its outside and might have panicked and might have galloped regardless of TURISMO coming back on it. 

Mr HACKETT said the legs of LIGHTNING MAGIC which was racing outside BET YOUR LIFE touched the disc on the sulky wheel of BET YOUR LIFE and contributed to the inward movement of BET YOUR LIFE. 

Mr BRANCH said TURISMO was not keeping up and he tried to go into the trail.  He said there was contact to his sulky wheel by the legs of LIGHTNING MAGIC. 

Mr TAUMANU said BET YOUR LIFE was not pushed inwards by LIGHTNING MAGIC and Mr BRANCH had driven into a gap that was not there.

DECISION AND REASONS

We reject the evidence of Mr HACKETT that LIGHTNING MAGIC contributed to the inward movement of BET YOUR LIFE. 

We accept the evidence of Mr MUIRHEAD and Miss STORMONT.  Their evidence is confirmed by the video film.  Mr BRANCH moved BET YOUR LIFE inwards when there was insufficient room to do so.  This caused TURISMO to be restrained with resultant interference to ROYAL TIGER and DAKOTA KID. 

We reject the evidence of Mr BUTT as to why ROYAL TIGER broke.  It broke because of the sharp restraining of TURISMO.  The chances of all three horses interfered with were seriously affected.  DAKOTA KID did remarkably well to recover and finish 4th.  TURISMO was denied the opportunity to trail POWERTOFLY which led all the way and won the race. 

Because of the serious affect on the chances of the three horses we exercise our discretion to relegate BET YOUR LIFE.  BET YOUR LIFE is relegated to immediately behind ROYAL TIGER, the final placings being:
