Under rule 869 (2) (a): An information was lodged by Stipendiary Steward Mr G J Allison alleging Mr P T Court, driver of NITRO used his whip excessively in the home straight. Mr Court admitted the charge and under Rule 1111 (1) (d) the charge was proven. Submissions as to penalty were heard. Mr Allison showed video evidence of the incident and Mr Court was shown to have hit his horse 23 times in the straight. In mitigation Mr Allison said that Mr Court has had an excellent record with no charges under this rule in the past twelve months. Mr Allison also said in the four years he had been a Stipendary Steward he could not recollect Mr Court being charged by him for any other offence and that Mr Court had readily admitted the offence. Mr Allison had asked for a fine of $200.00 Mr Court said he was on the favourite and probably got carried away as it is some time since he last drove a winner. DECISION: Allowing for Mr Court's excellent record and his ready admission of the offence, I agree that a fine of $200.00 is appropriate. J Eagles Chairman
