The Defendant being Mr H Cullen Junior Horseman, Mr Cullen admitted the breach and was present at the hearing. Mr B M Mangos senior horseman and also Mr Cullen's employer was also present at the hearing of this information. --The information stated that junior horseman H Cullen drove Room For me carelessly causing interference to No More Gold (G Rich), with 150 meters to run. --Mr Muirhead showed the video of the alleged incident and stated in his evidence that he viewed this breach at the lower end of the scale. --Mr Muirhead made submissions on penalty and stated that Mr Cullen has a clear driving record, and he viewed this breach as best dealt with by way of a fine at the lower end of the scale. --Mr Cullen and Mr Mangos both made submissions on penalty, Mr Mangos submitting that a monetary penalty at the lower end of the scale was requested. --Decision and Reasons. --Having taken into consideration the admission of the breach of rule, and Mr Cullen's very good driving record this Judicial Panel imposed a fine of $150.00 in this instance |
