Decision: Mr C Allison, stipendiary steward, has alleged that Mr Dunn, jnr driver, presented DAZZLE BROMAC in the birdcage with an incorrect saddlecloth number.

Mr C Allison, stipendiary steward, has alleged that Mr Dunn, jnr driver, presented DAZZLE BROMAC in the birdcage with an incorrect saddlecloth number. Mr Dunn appeared and stated that he did not admit the charge. He declined the assistance of a senior horseman. The matter was heard at Gore on March 15, it having been adjourned on March 6.

Mr Allison stated that DAZZLE BROMAC was number 15 and appeared in the birdcage with saddlecloth 2, which was the number of a scratched horse. Mr Dunn acknowledged he was in charge of Mr C Dalgety’s team for the night. He said the person assisting him had affixed the wrong number. He said he had charge of 3 horses and also had 8 drives, from race 2 to race 8. He said as a consequence he was pushed for time, had relied on another person to get it right, and had not double-checked the number himself.

The onus under the Rules is on Mr Dunn to ensure that he affixes the correct saddlecloth. This he did not do. I thus find the charge proved. Mr Allison has asked for a “standard fine” of $100. Mr Dunn has not previously appeared on such a charge. Taking into account he is a junior driver and had heavy commitments on the night, his good record, and the fact that the horse never proceeded on to the track with the wrong number, I impose a fine of $75 and remind him of his obligations under the Rules of Harness Racing. It is not sufficient to rely on someone else to get it right. The responsibility rests with Mr Dunn.
