Following the running of Race 4, Dennison’s Joinery Sprint, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Apprentice Jockey, Mr I Khairil, alleging a breach of Rule 871 (1) (d) - the careless riding Rule - in that he “allowed his mount ARCTIC ACE to shift in causing OUR GENES (C W Johnson) and LIL MONSTER (J B McDonald) both to be checked near the 100 metres”. 
 



Following the running of Race 4, Dennison’s Joinery Sprint, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Apprentice Jockey, Mr I Khairil, alleging a breach of Rule 871 (1) (d) - the careless riding Rule - in that he “allowed his mount ARCTIC ACE to shift in causing OUR GENES (C W Johnson) and LIL MONSTER (J B McDonald) both to be checked near the 100 metres”.
 
Mr Khairil and his employer, Mr S A Marr, were present at the hearing of the information. Mr Khairil indicated that he admitted the breach. The charge was found proved accordingly.

Mr Ching showed the head-on and side-on video replays of the final stages of the Race. He pointed out Mr Khairil on ARCTIC ACE in behind TURF FIRE (K Williams). He had “the door closed” in front of him when he was looking to improve. In looking for room, he shifted down to the inside of TURF FIRE and, in doing so, took the line of Mr Johnson’s mount, OUR GENES, who in turn put pressure on the horse on its inside, LIL MONSTER (J B McDonald). Two strides later, Mr Khairil attempted to pull off but the damage was done, Mr Ching submitted. Mr Khairil had gone for a gap that did not belong to him but belonged to OUR GENES.

In relation to penalty, Mr Ching submitted that Mr Khairil should be given credit for his guilty plea. He had a clear record over the past 12 months as far as careless riding charges were concerned. He described that record as “very good”. The Stewards believed this breach to be “mid-range”.  He recommended a suspension of between 3-5 days.

Mr Marr, on behalf of Mr Khairil, submitted that Mr Khairil had had his line dictated by another runner. He did push into the gap but took action to mitigate the damage.  He referred to Mr Khairil’s good record. He had experienced weight problems but had worked hard and had got his weight down in recent times.

Mr Khairil informed the Committee that he had riding engagements at the Oamaru meeting on Sunday, 26 July, and he sought a deferment of any suspension until after that meeting. Mr Marr pointed out that the upcoming Grand National meeting at Riccarton had two premier days.

In determining penalty, the Committee took into account Mr Khairil’s admission of the breach and his good riding record. The Committee agreed with Mr Ching’s assessment of the degree of carelessness as mid-range. The Committee was of the view that the appropriate penalty for the particular breach was a 4-days suspension. However, Mr Khairil was entitled to a 1 day discount for his guilty plea and his good race riding record.

Accordingly, Mr Khairil was suspended for a period commencing after the close of racing on Sunday, 26 July 2009, up to and including Saturday, 8 August 2009 – effectively 3 days.
