DECISION AND REASONS:

Following the running of Race 2, Wattyl Paints Handicap Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against CREAM OF THE CROP (K D Townley), placed 2nd by the judge, on the grounds of breaking from its gait and being lapped on by HAIRY MACLARY DRYDEN and NOW STOPUS, placed 3rd and 4th respectively by the judge.

Mr Townley, part-owner, trainer and driver of CREAM OF THE CROP, was present at the hearing of the information and indicated that he did not contest the relegation of CREAM OF THE CROP.

Mr N G McIntyre, Stipendiary Steward, showed a video replay of the final 100 metres of the Race. He pointed out CREAM OF THE CROP break from its gait just short of the finishing line and continue in a gallop across the line, finishing in 2nd placing. Mr McIntyre further pointed out that CREAM OF THE CROP was lapped on by the 3rd and 4th placed runners.

Mr Escott sought relegation of CREAM OF THE CROP to 4th placing.

The Committee was satisfied that CREAM OF THE CROP was not in its correct gait when its nose reached the finishing line and, further, that it was lapped on by the horses placed 3rd and 4th .

Accordingly, the protest was upheld and CREAM OF THE CROP was relegated to 4th placing. Consequent upon the relegation, the amended placings for the Race are as follows:
