FACTS:

--

Following race 2 an Information was filed pursuant to Rule 614 (2) by the Informant Mr J Oatham.  He alleged that Mr M Faber trainer of the winner FLETCHER BAYBE in race 2 omitted to add a towel when saddling his horse. 

--

SUBMISSION(s):

--

Mr Oatham said he had nothing further to say regarding the charge as it was all fully covered in the earlier enquiry regarding the disqualification of the horse, FLETCHER BAYBE, from Race 2.

--

Mr Faber when asked admitted his carelessness in leaving the towel off when saddling up.

--

 

--

PENALTY SUBMISSIONS:

--

Mr Oatham said Mr Faber had never given the stewards any trouble.  However he said the consequences arising from Mr Faber’s mistake were far reaching.  He said there had been similar charges with lead bags being left off which incurred both disqualification and $1000 fines.  He therefore submitted a fine of $1000 would be appropriate.

Mr Faber had nothing further to say.

REASONS FOR PENALTY:

--

The Committee considered all evidence before imposing an appropriate penalty.  We have taken into account Mr Faber’s guilty plea and his very good record.  However these must be balanced against the losses suffered by the horse’s connections and the betting public through Mr Faber’s actions.

PENALTY DECISION:

--

Accordingly after taking all the above facts into account we impose a fine of $1000.
