Following Race 8 an information was laid by Stipendiary Steward Mr A R Coles against apprentice S Phelan alleging a breach of Rule 871 (1) (d) namely careless riding.

Following Race 8 an information was laid by Stipendiary Steward Mr A R Coles against apprentice S Phelan alleging a breach of Rule 871 (1) (d) namely careless riding.
--The information reads as follows :
--S Phelan the rider of D'CASH FLYS FREE (no. 16) permitted his mount to shift inwards near the 900 metres when not sufficiently clear of WAITOKI AHI (no. 9) ridden by J Gillies who was forced into the line of DIAMONDS FLO (no. 3) ridden by J Rathbone who was checked. Mr S Phelan admitted the breach of information no. 6077.
--Assistant Stipendiary Steward Mr W Robinson demonstrated the incident on race videos and placed his interpretation. He said that Mr S Phelan allowed his mount to move inward on the point of the bend into WAITOKI AHI (no. 9) ridden by J Gillies who was forced into the line of DIMONDS FLY, ridden by J Rathbone, causing a sharp check.
--The committee carefully reviewed the race video. Mr S Phelan accepted the incident as demonstrated by Mr W Robinson.
--PENALTY
--The only issue for determination is penalty. Mr Coles submitted that a suspension and a fine be imposed because the jumping season had finished.
--Mr S Phelan gave explanation that his horse was hanging just prior to the incident.
--After considering all submissions by Mr A Coles and Mr S Phelan and taking into account the following :

- Plea of guilty. --
- The degree of carelessness. --
- Riding record - young apprentice, inexperienced, commenced his apprenticeship on 1 August 2007. --
- Mr Phelan's explanation that his mount was hanging. --
- The horses suffered consequential interference.
Mr Phelan's licence is suspended from the conclusion of racing on Wednesday 10 October 2007 up to and including Wednesday 17 October 2007, and a fine of $250 is imposed.
