DECISION & REASON
--Following the running of Race 2 the Stipendiary Stewards filed an information alleging a breach of Rule 869 3 (b). The information alleged that Mr Williamson drove carelessly with approximately 300 metres to run allowing his charge Resolution Bay to strike the wheel of Will Play (C D Thornley) resulting in Delma Hall, Goodonyamate and Operative Motoring being checked and two drivers being dislodged from their carts.
----At the outset of the hearing Mr Williamson confirmed that he admitted the breach but wished to be heard in respect of penalty. The video evidence of the incident was viewed. The charge is accordingly found proven. Mr Escott submitted that a substantial period of suspension should be imposed and noted that Mr Williamson, who has held a licence since 1966, has had only 33 race day drives and only 3 drives in the last season. He indicated that the penalty sought by the Stipendiary Stewards was suspension for a period of 3 months.
----Mr Williamson for his part said the horse was pulling but he should not have allowed it to strike the cart of the horse in front and was apologetic to all concerned in respect of the outcome of the interference, that is, 2 horses falling and a further horse losing all chance.
----In arriving at the penalty the Committee took into account the submissions of both parties and noted that the level of carelessness was of the upper end, the consequences being serious in that 3 other horses, apart from his own, lost all chance because of his driving. The Committee gives some credit to Mr Williamson for his early guilty plea and his clear record over the last twelve months. The Committee is of the view that a substantial suspension is appropriate given the small number of drives that Mr Williamson has and, accordingly, his licence to drive is suspended from the completion of racing today, 3rd January 2007, to the completion of racing on 25th March 2007.
