DECISION & REASON
--Following the running of race number 9 an information was lodged by the Stipendiary Stewards pursuant to rule 869 (3)(b) alleging that Mr D J Butt drove carelessly when shifting off the back of Tar Vicola resulting in a check to Good Looking Guy.
----At the outset of the hearing the Committee noted that Mr Butt admitted the breach and did not wish to be heard in respect of penalty. The charge is found proven.

The Stipendiary Steward demonstrated the incident with the assistance of a video camera which showed Tar Vicola tiring and Mr Butt moving Caracal off its back but in doing so contacting Good Looking Guy causing that horse to break.
The Stipendiary Stewards recommended a monetary penalty only and after taking into account the mitigating factors the Committee imposes a fine of $200.
