Decision:

Following the running of Race 5, Vero Insurance Handicap Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr K G Coutts, alleging a breach of Rule 869 (3) (b) in that “with approximately 600 metres to run, Mr Coutts angled DARBY DOLL wider on the track and, in doing so, contacted the sulky wheel of HELPLESS DANCER causing his horse to gallop”.



Following the running of Race 5, Vero Insurance Handicap Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr K G Coutts, alleging a breach of Rule 869 (3) (b) in that “with approximately 600 metres to run, Mr Coutts angled DARBY DOLL wider on the track and, in doing so, contacted the sulky wheel of HELPLESS DANCER causing his horse to gallop”.

Mr Coutts had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(3)  No horseman in any race shall drive:-
      (b)  carelessly.

Mr Ydgren showed a video replay of the incident with approximately 600 metres to run. He pointed out Mr Coutts, driving DARBY DOLL, in the one out, one back position trailing HELPLESS DANCER (B Weaver). Mr Coutts then commenced to angle out in front of AMAROK (D J Butt) and, in doing so, the near front leg of his horse struck the sulky wheel of HELPLESS DANCER and galloped.

Mr Ydgren informed the Committee that Mr Coutts had a clear record as far as breaches of the careless driving Rule were concerned. He recommended a fine of $200.

The Committee was satisfied, having regard to Mr Coutts’ admission of the breach, his clear record and the degree of carelessness, that a fine of $200 was appropriate and Mr Coutts was fined the sum of $200 accordingly.
