Stipendiary Steward, Mr S Ching alleged that STARRY ANGEL or its rider, placed 3rd by the judge interfered with the chances of No.4 MEGAGEM placed 4th by the judge. The interference occurred approximately 100 metres from the finish.

DECISION AND REASONS:
--Stipendiary Steward, Mr S Ching alleged that STARRY ANGEL or its rider, placed 3rd by the judge interfered with the chances of No.4 MEGAGEM placed 4th by the judge. The interference occurred approximately 100 metres from the finish.
--Using video to support him, Mr Ching showed that Mr Holmes allowed his horse to run out, pushing COUP CHRISTCHURCH (C Johnson) sideways onto Mr Sellah's horse (MEGAGEM). This caused Mr Sellah to be pushed violently sideways and to change direction markedly.
--Mr Holmes claimed Mr Johnson had contributed to the incident.
--Mr Ching, using video again refuted this and pointed out that Mr Johnson was on the quarter of Mr Holmes' horse and was entitled to be where he was.
--Mr Clutterbuck (representing Mr Walker, trainer of STARRY ANGEL) admitted that Mr Holmes had rolled out but he felt Mr Johnson had contributed to the incident.
--Mr Anderton (trainer of MEGAGEM) said Mr Holmes came out from the fence at the straight entrance and had ended up wide enough to have pushed his horse from three wide to six wide.
--Decision:
--The Committee told Mr Holmes that they found the movement of his horse was severe and also that Mr Johnson was entitled to be where he was. Also, that they found that Mr Sellah was propelled violently sideways as a result and although the final margin was 1-1/2 lengths between third and fourth they were confident that he would have finished third if unimpeded. STARRY ANGEL was relegated to 4th, and MEGAGEM was promoted to 3rd.
