Under Rule 508 (2) and (5) an information was lodged by Stipendiary Steward Mr S Ching alleging that Trainer Mr P Harris failed to declare riders by the required time for PENTARNIE and ADELARIVA in race 8 and TUTUSAFORE in race 11.

Under Rule 508 (2) and (5) an information was lodged by Stipendiary Steward Mr S Ching alleging that Trainer Mr P Harris failed to declare riders by the required time for PENTARNIE and ADELARIVA in race 8 and TUTUSAFORE in race 11.

Mr Ching began by explaining that he had attempted to assist trainers meet their declaration nominations 'on time'; he had extended the time by some 6 hours on the Saturday - from 1pm to 7pm. At the closing time Mr Harris had not declared riders for the three horses as listed.

In his defence, Mr Harris listed several factors which, in his opinion, mitigated his case. They were :

  1. He did ring at approximately 7:15 - phone unattended.
  2. --
  3. Trouble contacting rider to confirm ride.
  4. --
  5. He had been contacted by Craig Baker, on Sunday at approximately 2:37 pm - still problems re jockeys etc.
  6. --
  7. There was mention of a computer crashing.

DECISION

The committee found the charge proven. The committee considered that Mr Harris had had ample time to organise and declare riders. (Most other trainers had done this with few problems.)

PENALTY

--

The committee decided that in this instance a fine of $50 per horse was appropriate. Total $150.00. Before coming to this decision, the committee took the following into account :

  1. Last race on Saturday was 6:37 pm - closing time for declarations was 7:00 pm.
  2. --
  3. Mr Harris made an attempt to call at approximately 7:15 pm.
  4. --
  5. Mr Harris' good record.
  6. --
  7. Mr Harris' large number of starters and double acceptors.
