Following the running of Race 6, Anthony Shearer Limited Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, by KIWI FANTASY (R D Holmes), placed 9th by the judge, against SIR ARTSPLACE (M P Jones), placed 2nd by the judge, on the grounds of interference after 200 metres.

Mr Jones was present at the hearing of the information and indicated that he was representing the connections of SIR ARTSPLACE at the protest hearing.

Mr Escott showed a video replay of the first 200-300 metres of the Race. Mr Holmes stated that Mr Jones had settled “half a cart off the leader’s back” and had attempted to come out and, in doing so, had “gone underneath” Mr Holmes’ horse. The video showed KIWI FANTASY go off stride after approximately 200 metres. Mr Holmes confirmed that contact was made when Mr Jones’ stay went underneath his horse’s leg.

When asked by Mr Escott, Mr Holmes admitted that the horse outside, MOTU HOT SHOT DUDE (M P Edmonds), had moved down but was forward of Mr Holmes at that stage. That horse was partly to blame for the interference that his horse suffered – his horse was “the meat in the sandwich”, Mr Holmes said. However, there had been outward movement from Mr Jones on his inside. There was definite contact, Mr Holmes said. He admitted that Mr Edmonds also “had a look back”. If Mr Edmonds had not been on his outside, Mr Holmes stated, he would have been able to stay on the outside of Mr Jones.

At that point in the hearing, Mr Escott told the Committee that, after hearing Mr Holmes’ evidence, he did not wish to proceed with the protest. Mr Holmes declined the opportunity to continue with the protest on his own behalf.

Mr Jones was asked by the Committee for his views on the incident. He stated that, in his view, Mr Edmonds had come across “relatively quickly” and put pressure on Mr Holmes. He, Mr Jones, had just kept his line.

The Committee was satisfied, from observing the video replays, that Mr Jones had not been the cause of any interference suffered by Mr Holmes.

Leave to withdraw the protest was granted and the judge’s placings for the Race stand.
