RACE NO. 8 INFORMATION NO.13021 RULE NO. 869
--Following the running of Race 8 a protest was lodged by Junior Driver Mr N CHALMERS ( HORSE 3 SEMPER FELIX), placed 13th by the Judge against Horse 11 MIDDLETON (Junior Driver J COX),placed 1st by the judge on the grounds of interference with approximately 450 metres to run.
--The Information was completed by Stipendiary Steward Mr J MUIRHEAD for Mr CHALMERS who then signed it as the informant.
--Mr Fergusson appeared to assist Mr Chalmers at the enquiry.
--Also present was Mr Dickie trainer of Semper Felix and Mr P Scaife trainer/owner of Middleton.
--Mr Chalmers was advised at the outset that he could seek advice and assistance from Stipendiary Mr Muirhead, who did not support the Protest
--Mr Chalmers then gave evidence and referred to video tapes of race 8 near the final turn with approximately 450 metres to run. He described how he had forced Mr COX 3 wide to 4 wide after the turn and as they straightened for home how Mr Cox horse had run in and touched his horse's legs causing it to gallop.
--Mr Fergusson assisting Mr Chalmers explained the relevant section of the race.
--Mr Chalmers was in the 1/1 with Mr Cox improving around him, Mr Chalmers has moved him out as is was entitled to and just as Mr Cox has got past, he has run in and his wheel has made contact with Mr Chalmers horses back leg. Mr Chalmers horse had gone off balance
--and galloped. It was possible that Middleton has shied at the crowd as he appeared to move in although Mr Cox was trying to drive him outwards
--In response Mr Cox agreed that he had been properly taken 4 wide and had progressed past Mr Chalmers, he had shied and lugged in a little
--He did not believe there was contact and thought that Semper Felix may have broken because of a bit of tightening though his horse running in and Mr Edmonds (INTHEPOCKETTHISTIME) on his inside coming out.
--Mr Chalmers said he had no problems with Mr Edmonds on his inside but was sure that Mr Cox had made contact with his horse.
--Mr Cox denied there was any contact and said in his opinion Semper Felix had become unbalanced with the tightening and a few paces later had galloped but there had been no contact.
--Decision
--The accounts from both Mr Chalmers and Mr Cox agree in general with the major dispute being whether or not Mr Cox made contact with
--Semper Felix when his drive moved in after improving past him after the turn.
----It is difficult to see where contact was made with nothing apparent on video footage. Semper Felix may have been put off balance by the inward movement of Middleton but Semper Felix appears to have broken after this and free of interference
----The Protest is disallowed and the judge's placings will stand
