DECISION AND REASONS:
--Following the running of Race 3, the Teltrac Communications Mobile Pace, an information was lodged by Stipendiary Steward Mr N. M. Ydgren against Mr J. W. Cox, driver of SONNY ALBERT (9), alleging a breach of Rule 869(3)(b). The charge was that Mr Cox drove carelessly at about the 400 metre mark causing interference to AFTER MIDNIGHT (11) driven by Mr M. P. Jones which broke.
--Mr Cox had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.
--Mr Ydgren used video coverage of this incident to show that Mr Cox had moved outwards when insufficiently clear, with resultant tightening which caused AFTER MIDNIGHT to break.
--Mr Cox explained the circumstances and said that he made an error of judgement.
--Penalty: In relation to penalty Mr Ydgren advised that Mr Cox had no previous relevant convictions and recommended a fine of $200-00. Mr Cox had no submissions to make on penalty. We were satisfied that fine of $200-00 was appropriate in this case and Mr Cox was fined this amount.
