Decision: --

An Information was lodged by Stipendiary Steward Mr TW Taumanu against junior horseman M White for a breach of Rules 869(4) & 869(6)(b)(c)

--

Information 66299      Rules 869(4) & 869(6)(b)(c)

--

An Information was lodged by Stipendiary Steward Mr TW Taumanu against junior horseman M White for a breach of the above Rules in that he improved Lunar Sands outward to three wide forcing Rosie Ryan (Driver T Shaw) to race wider on the track with 1300 metres to run.

--

--

Mr White admitted the charge and was present at the Hearing and had Mr P Butcher to represent and support him.

--

--

Mr Taumanu demonstrated the incident by use of the video film. Mr Taumanu advised also that Mr White readily acknowledged that he had moved out three wide and had cooperated fully.

--

--

Mr Butcher on behalf of Mr White pointed out that despite the outward movement Mr Shaw was able to move back in after a short period and Mr Butcher suggested that it was not a major incident.

--

--

Mr White does however have two previous charges of this type on his record and I advised him that future judicial committees would not look favourably upon him for further transgressions of this kind.

--

--

In respect to the penalty Mr Taumanu recommended a suspension for two driving days which would be the 8th and the 15th of September and after discussion Mr Butcher and Mr White accepted that recommendation.

--

--

Mr White's horseman's license is accordingly suspended up to and including the 15th of September 2006.
