Following the running of race 5 an information was lodged by the Stipendiary Stewards against Mr Fairbairn, the trainer of SWAMP QUEEN, alleging that he presented his mare without the removable hood that she had raced in at her last start.



Following the running of race 5 an information was lodged by the Stipendiary Stewards against Mr Fairbairn, the trainer of SWAMP QUEEN, alleging that he presented his mare without the removable hood that she had raced in at her last start.

At the outset of the hearing the judicial committee noted that Mr Fairbairn did not admit the breach and did not wish to be present. Mr Ydgren advised that when spoken to regarding the charge Mr Fairbairn indicated that he did not have the time to attend the hearing.

The Racecourse Detective, Mr Clapp, when asked by Mr Ydgren, if he had spoken to Mr Fairbairn regarding the attendance at the hearing advised that he had and that Mr Fairbairn was in an agitated and aggressive mood but he admitted to him that he had changed the gear on the horse since its last start.

The Committee, after taking into account the evidence of the Racecourse Detective and the Stipendiary Stewards, finds the charge proven.

Mr Ydgren in respect of penalty advised that he sought a fine only and admitted there was no previous records with Harness Racing New Zealand of any breach of the current rule or the rule it replaced, by Mr Fairbairn.

The Committee, after taking into account the submissions of the Stipendiary Stewards, agrees that a fine only is appropriate and, accordingly, on this occasion Mr Fairbairn is fined the sum of $100.00 giving him credit for his previous good record.
