Following race 2 Mr B Peterson, the trainer of BRAVE RUNNINGBEAR, lodged a protest pursuant to Rule 876(1). He alleged that POSSUM placed first by the Judge interfered with the chances of his horse BRAVE RUNNINGBEAR, placed third by the Judge

DECISION & REASON:

--

Following race 2 Mr B Peterson, the trainer of BRAVE RUNNINGBEAR, lodged a protest pursuant to Rule 876(1). He alleged that POSSUM placed first by the Judge interfered with the chances of his horse BRAVE RUNNINGBEAR, placed third by the Judge. This was alleged to have occurred inside the final 200 metres.

--

The margins at the post were ¾ length and a long head between second and third.

--

All connections were informed of the protest.

--

Present at the inquiry were:

Mr J Georgetti, trainer of POSSUM

--

Mr J Waddell, rider of POSSUM

--

Mr B Peterson, trainer of BRAVE RUNNINGBEAR

--

Miss S Collett, rider of BRAVE RUNNINGBEAR

--

Mr Peterson demonstrated the video films and showed where POSSUM in the final stages of the race ran in and crowded BRAVE RUNNINGBEAR causing S Collett to stop riding. He said that POSSUM had come in 3 or 4 metres and in his opinion had caused his horse a better placing.

--

Miss Collett, rider of BRAVE RUNNINGBEAR, said that POSSUM had rolled in onto her horse causing her tightening. She said she had to stop riding and would have certainly finished second.

--

Mr J Waddell, rider of POSSUM, said that this was just tight racing and that S Collett had not stopped riding. He also stated that the second horse had come from behind the third horse and that S Collett was always going to run third.

--

Mr Georgetti had nothing to say leaving it to his rider.

--

Mr George, Stipendiary Steward, when asked for his interpretation of the incident said that it was clear that POSSUM did move in and BRAVE RUNNINGBEAR had its rightful line of running taken.

--

The Committee carefully considered all evidence and reviewed the video films.

--

We are clearly of the opinion that BRAVE RUNNINGBEAR did suffer interference at approximately the 100 metre mark when POSSUM moved in making contact with BRAVE RUNNINGBEAR causing S Collett to stop riding.

--

We must now decide whether that interference affected the chances of BRAVE RUNNINGBEAR finishing in a better place. We determined that his chances were affected by this inward movement.

In applying our discretion before making a decision we took into account the following:

  1. The margin between second and third at the post.
  2. --
  3. The degree of interference suffered by BRAVE RUNNINGBEAR through the inward movement of POSSUM.
--

Because these factors are in the favour of BRAVE RUNNINGBEAR we uphold the protest and the placings shall now be:

2 POSSUM third

--

14 ITALIENNE fourth

11 INDIAN WELLS fifth
