Decision:
Following the running of race 7, the Powell Memorial Fillies and Mares Pace, M P Jones the driver of the second placed HOME VENDOR lodged a protest against 1st place being awarded to PATCHWORK STAR driven by S G Dickson.
Following the running of race 7, the Powell Memorial Fillies and Mares Pace, M P Jones the driver of the second placed HOME VENDOR lodged a protest against 1st place being awarded to PATCHWORK STAR driven by S G Dickson.
--It was alleged that PATCHWORK STAR shifted out over the concluding stages of the race.
--At the commencement of the hearing Mt Jones stated that he would be representing the connections of HOME VENDOR while Mr Stapleton said he would represent PATCHWORK STAR with the assistance of Mr Dickson.
--No other connections wished to attend.
--When making his submission Mr Jones used the head on film to show where he believed he was taken over extra ground when PATCHWORK STAR ran out underneath him over the latter stages of the race. He stated that he had to check his horse twice over the final 100m of the race and as such this had affected his chances. The margin between the two horses at the finish being one and a quarter lengths.
--In response to a question from the Chairman, Mr Jones could not say if his chances of finishing in a higher placing had been effected by PATCHWOOD STAR. But rather his response was that he was forced over extra ground and this was in contradiction to the rules.
--Mr Stapleton in his submission acknowledged that there had been some outward movement from his horse, however he contended that the effect on Mr Jones's horse was minimal. He stated that his horse was always in control of the race and was in fact going away at the finish.
--Stipendiary Steward Mr McIntyre, when making his observation, stated that although there had been some outward movement by PATCHWOOD STAR this had been limited and in his view this had not affected its chances of HOME VENDOR finishing in a higher placing.
--DECISION AND REASON.
--The committee finds that with a little over 100m to run PATCHWOOD STAR, who has been leading the race, has moved out and has caused the horse on its immediate outside, HOME VENDOR to take some evasive action. The committee finds that the interference claimed by Mr Jones could be better classified as inconvenience as at no time in the run home has Mr Jones had to stop driving his horse out.
--The committee also finds that the actions of PATCHWOOD STAR moving out have not affected the chances of HOME VENDOR finishing in a higher placing.
--In reaching this finding of significance is that over the final 50m or so of the race PATCHWOOD STAR has actually been going away from the rest of the field and in particular HOME VENDOR.
--Therefore after carefully considering all matters the committee is dismissing the protest and the judges placing's stand.
